Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Unbed website, store, mobile applications, hardware products, and related services (collectively, the “Services”) provided by Unbed App (“Unbed,” “we,” “us,” “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Nothing in these Terms affects rights you may have under applicable consumer protection laws (e.g., legal warranty in Québec, EU consumer rights). Where those rights conflict with these Terms, your statutory rights prevail.


1) Eligibility & Accounts

  • You must be at least the age of majority in your place of residence to use the Services or make purchases. If you allow a minor to use the Services, you do so as their legal guardian and remain responsible.

  • You agree to provide accurate, current account, contact, and payment information and to keep it updated.

2) Scope of Services

  • Our Services include (a) this website and store, (b) mobile apps (e.g., iOS), (c) physical products (e.g., the Unbed NFC block), and (d) any future subscriptions, software features, or accessories.

3) App License & Device Requirements

  • We grant you a limited, non-exclusive, non-transferable license to install and use our app on a device you own or control, solely for personal, non-commercial use.

  • You are responsible for maintaining required permissions and settings (e.g., notifications, background refresh, Focus/Do Not Disturb, ringer/volume, battery, system updates) needed for alarms to work as intended.

4) Important Disclaimer — Not a Medical or Safety Device

  • Unbed is a behavior-change and alarm aid, not a medical device and not a system for emergency or life/safety purposes. It is not intended to diagnose, treat, cure, or prevent any condition.

  • Do not rely on Unbed as your sole critical alert. Always maintain a backup alarm and reasonable safeguards for time-sensitive obligations.

5) Missed Alarms & Consequential Losses

  • We do not guarantee that any alarm will trigger, sound, or wake you in every circumstance. Device settings, OS behavior, battery, hardware limitations, network conditions, and user actions can affect performance.

  • To the maximum extent permitted by law, Unbed is not liable for any missed alarms or resulting consequences, including but not limited to missed classes, appointments, travel, wage loss, disciplinary actions, or termination of employment. See also Section 16 (Limitation of Liability).

6) Orders, Shipping & Risk of Loss

  • We may limit or cancel orders at our discretion (e.g., suspected fraud, bulk/resale). We’ll notify you using the contact info you provided.

  • Title and risk of loss transfer upon delivery to the carrier, except where prohibited by law.

7) Returns & Refunds

  • Returns and refunds are governed by our Refund & Returns Policy (incorporated by reference). Please review it before purchasing.

8) Subscriptions, Trials & Billing (if offered)

  • Some features may be offered via auto-renewing subscriptions. You’ll be shown pricing, term, and renewal details before purchase.

  • App Store / Apple ID purchases: Billing, trials, renewals, cancellations, and refunds are handled by Apple. To manage or cancel, use your device Settings → Apple ID → Subscriptions (or equivalent). We cannot issue refunds for purchases made through Apple.

  • Unless you cancel at least 24 hours before the current term ends, your subscription auto-renews at the then-current price. Taxes may apply.

  • We may change pricing or features; changes will apply on your next renewal term and will be disclosed in advance where required.

9) Hardware Use & Care

  • Use only as instructed. Avoid exposure to extreme temperatures, liquids, strong magnetic fields near sensitive devices, or misuse. We’re not responsible for damage caused by improper use or unauthorized modifications.

10) User Content & Feedback

  • If you submit ideas, reviews, UGC, or feedback, you grant Unbed a worldwide, royalty-free, perpetual license to use, reproduce, modify, and display them for operating, improving, and promoting the Services, without obligation to compensate you. You represent you own or control the rights to what you submit.

11) Acceptable Use

You may not use the Services to: (a) violate any law; (b) infringe IP or privacy rights; (c) post or transmit malware, spam, or harmful code; (d) scrape or reverse engineer except as permitted by law; (e) attempt to bypass security; (f) misrepresent your identity; or (g) engage in abusive, harassing, or discriminatory conduct.

12) Third-Party Services & Links

  • The Services may link to or integrate with third-party websites or services (including Apple and Shopify). We are not responsible for third-party content, terms, or practices. Your use of third-party services is governed by their terms.

13) Intellectual Property

  • The Services and all content are protected by IP laws. Except for the limited app license above, no rights are granted. You may not use our trademarks, trade dress, or branding without our prior written consent.

14) Beta or Experimental Features

  • We may offer beta features labeled as such. They are provided as-is, may be unstable, and may be modified or discontinued at any time.

15) Disclaimers

  • The Services (including the app, hardware, and any content or coaching insights) are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and non-interruptionto the extent permitted by law.

  • We do not warrant that alarms will sound in all conditions or that results (e.g., waking success, sleep improvements) are guaranteed.

16) Limitation of Liability

  • To the maximum extent permitted by law, Unbed and its officers, directors, employees, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost wages, job loss, academic penalties, missed travel, or data loss, arising out of or related to the Services—even if advised of the possibility.

  • Our aggregate liability for direct damages will not exceed the greater of **(a) the amount you paid to Unbed for the product or subscription that gave rise to the claim in the six (6) months preceding the event, or (b) $100 USD (or $135 CAD).

  • The above does not exclude or limit liability that cannot be excluded under applicable law (e.g., for fraud, gross negligence, death or personal injury caused by negligence). For Québec consumers, nothing here limits rights under the legal warranty.

17) Indemnity

You agree to indemnify and hold Unbed harmless from claims, damages, liabilities, costs, and fees (including reasonable legal fees) arising from your breach of these Terms or misuse of the Services, except to the extent caused by our own negligence or breach of law.

18) Suspension & Termination

We may suspend or terminate access to the Services (or any part) at any time for violations of these Terms or where required by law. Sections that by their nature should survive termination will survive.

19) Changes to the Services or Terms

We may update the Services and these Terms from time to time. If we make material changes, we will post the new Terms and update the “Last Updated” date. Your continued use after changes means you accept the revised Terms.

20) Privacy

Your use of the Services is also governed by our Privacy Policy (incorporated by reference). Please review it to understand how we collect and process personal data.

21) Governing Law & Venue

  • If you are a consumer domiciled in Québec, these Terms are governed by the laws of Québec and Canada, and exclusive venue lies with the courts of Québec, district of Montréal, without prejudice to any mandatory rules protecting consumers.

  • For all other users, these Terms are governed by the laws of Ontario, Canada (without regard to conflict-of-law rules), and you consent to the jurisdiction of the courts located in Toronto, Ontario.

  • Where local consumer law requires a different governing law or forum, that law/forum will apply.
